On Nov 19th. HUD issued its final rule on project based vouchers with low income tax credit [LIHTC] projects in the Federal Register, effective December 19th. The PDF version of those rules Is HERE.
The publication notice says that the proposed rules previously issued on May 1, 2007 was adopted without modification as the final rule.
No delegation of subsidy layering by the Public Housing [Cylinder].The publication notice also says that a public comment made on the proposed rule urging delegation of subsidy layering to local agencies was rejected as being “beyond the scope of this rule making”. Presumably this means that HUD public housing staff will continue to have the responsibility for review of every project based voucher proposal for projects with LIHTC. In contrast to HUD's Public Housing [cylinder], for Multifamily [cylinder] HUD programs, subsidy layering reviews for LIHTC projects have been delegated for years by HUD to the Oregon Housing and Community Services Department (and other similar HFA's around the country).
