Metro staff have advised that that Exhibit D will be presented to Metro Council in draft form but NOT until the Metro scheduled October 20 public hearing where Metro Council may act on the draft Ordinance.  

I have previously commented in a post HERE that I thought the absence of Findings of Fact and Conclusions of Law from public hearings on a draft ordinance kept from the public one of the most concise and complete descriptions of the rational for Metro Council action. (I will leave it up to the lawyers to weigh in whether excluding these documents from all but the final public hearing provides a basis for a legal challenge to the ordinance).
